Terms and Conditions of Various Voices London

1. This is an agreement between Various Voices London ('VVL') and you, the person who applies to be a delegate at the Various Voices Festival to be held in London in May 2009 ('the Festival'). By applying to be registered as a delegate at the Festival you agree to be bound by the terms of this agreement.

Registration as a delegate

2. Applications will not be accepted by post, fax or telephone.
3. If you are under 18, your application must be accompanied by a letter of permission signed by your parent, guardian or responsible adult e-mailed to which must include your full name, address and the name of the choir, if any, you intend to sing with.
4. Payment must be made in pounds sterling. VVL accepts no liability for any loss suffered due to fluctuating exchange rates or charges incurred for exchanging currency or transferring funds.
5. VVL reserves the right to refuse to accept any application in its absolute discretion without giving any reason for doing so.
6. If VVL accepts your application, VVL will notify you that you have been registered as a delegate by sending you an e-mail to the address given on your application form.

Transfer of registration

7. Transfers of your registration as a delegate to another person are possible up to 1 April 2009. In order to apply to transfer your registration, you must send an e-mail for instructions on the procedure to
8. VVL reserves the right to refuse to accept any transfer in its absolute discretion without giving any reason for doing so.
9. If VVL accepts the transfer, VVL will notify the new delegate by sending the delegate an e-mail to the address given on the delegate's application form.
10. VVL reserves the right to charge an administration fee for the transfer.

Cancellation of registration by delegate

11. You may cancel your registration as a delegate by sending an e-mail to
12. If VVL receives notification of your cancellation on or before 1 March 2009, you will receive a refund in pounds sterling of 50% of your payment. You may choose to donate your refund to the VVL New Choirs Support Fund.
13. If VVL receives notification of your cancellation after 1 March 2009, you will not receive a refund.

Festival events and performances

14. The events and performances appearing on VVL's website and in VVL's promotional literature are for guidance purposes only and will change as plans are finalised as the Festival approaches. Whilst they represent VVL's current intentions as to the Festival, there is no guarantee that any particular event or performance will take place.
15. If you are applying to perform with your choir or with others at the Festival or participate in any other Festival event, VVL expects you be committed to delivering the performance or to participating in the event. Evidence of lack of commitment, such as late arrival or failure to comply with agreed rehearsal schedules, could prevent you, your choir and others performing or participating. VVL's decisions about performance and participation are final.
16. You or your choir is responsible for obtaining and paying for any copyright, composer and publisher agreements required for works to be performed at the Festival. Please address enquiries to . Failure to comply with this clause, or to provide documentary evidence to satisfy VVL that you have complied with this clause, in respect of any work may mean that you will not be permitted to perform that work at the Festival. VVL's decisions about performance are final.
17. VVL reserves the right in circumstances beyond VVL's reasonable control to change the timing and venues of Festival events and performances and to cancel Festival events and performances as determined by VVL in its absolute discretion.
18. VVL is not liable for any loss or damage suffered if any Festival event or performance does not proceed or if for whatever reason you do not participate in an event. Emailed applications for ex gratia compensation will be considered:
19. Festival events and performances may proceed in all weather conditions provided VVL is satisfied that it is safe for the event to proceed.

Conduct

20. You agree to comply with the rules of the Festival determined by VVL and with any reasonable written or verbal instructions given by VVL, its employees or agents including, but not limited to, any reasonable request to submit to a bag search.
21. Some venues and institutions used by VVL may impose conditions of entry and other restrictions in addition to the rules of the Festival. You agree to comply with any such conditions or restrictions.
22. You must not behave in an unacceptable way. Unacceptable behaviour includes, but is not limited to, physical or verbal abuse; harassment; drug-taking; smoking in non-permitted areas (the Southbank Centre is a non-smoking venue); excessive intoxication; nudity; lewd, overtly sexual or other anti-social behaviour; racist, homophobic, sexist, misogynist, misandrist, age-ist behaviour (including performing actions, words or songs construed as such); and the carrying or knives, weapons or any other items construed as weapons.

Property rights

23. You agree not to make any unauthorised use of the Festival logo or VVL trade marks including "Various Voices London".
24. You agree not to act in a way which would compete with Festival sponsors or devalue Festival sponsors' rights regarding branding potential, logo rights or exclusive presence at Festival events. If at any time during the Festival, VVL, its employees or agents determine your actions compete with Festival sponsors or may result in the devaluation of such Festival sponsors' rights, you understand that you will be required immediately to cease such actions, including, in particular, the removal of any uniforms, costumes, signs or other items.
25. VVL or its appointed agents may record your likeness and voice during the Festival. You agree to assign any of your rights to that recorded material to VVL in perpetuity and authorise the reproduction, sale, broadcast, distribution and dissemination of that material by any means whatever without geographic or time limitation.

Personal data

26. You agree that VVL may provide your personal data (including your likeness) to organisations and institutions in connection with the Festival. VVL will at all times comply with the Data Protection Act 1998.

Insurance and damage to property

27. You agree that you have been advised to acquire adequate travel, personal accident and health care insurance and that it is your responsibility to obtain your own such insurance to cover yourself and your property during the Festival.
28. VVL is not liable for any loss or damage to your property during the Festival.

Cancellation of registration by VVL

29. VVL may at any time cancel your registration as a delegate with immediate effect if you breach the terms of this agreement. If VVL cancels your registration, you will not be permitted to participate in the Festival either as a delegate or otherwise; nor will you receive a refund or any form of compensation for any loss.

Applicable law

30. This agreement is governed by the laws of England and Wales. You consent to the exclusive jurisdiction of the courts of England and Wales in all matters regarding it.
